Order 30/01/2025
1. These bail applications have been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested in connection with FIR No.315/2024 registered at Police Station Sadar Jaipur, District Jaipur (West) for offence punishable under Section 140(2) of BNS. Charge-sheet has been filed for offences under Sections 140(2), 115(2), 126(2), 127(7), 190, 308(5) & 61(2)(a) of BNS.
2.
Learned counsel for the petitioners submit that petitioners have falsely been implicated in this case. It is submitted that after lodging FIR, another application was submitted by the complainant wherein he has clearly mentioned that in FIR, wrong facts were
[2025:RJ-JP:4341] (3 of 4) [CRLMB-15580/2024] mentioned by him. It is submitted that after investigation, police has submitted the charge-sheet in this matter for the offences punishable under Sections 140(2), 115(2), 126(2), 127(7), 190, 308(5) & 61(2)(a) of BNS. Learned counsel argues that petitioners have no criminal antecedents and they are in custody since long. Trial will take considerable time in its conclusion and further custody of the petitioners would not serve any fruitful purpose.
3. Learned Public Prosecutor assisted by learned counsel for the complainant vehemently oppose the submissions made by counsel for the petitioners.
4. I have considered the contentions.
5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners as also considering the material available in the form of charge-sheet and the fact mentioned by the complainant himself in the subsequent application and also considering the fact that petitioners have no criminal antecedents and they are in custody since long, but without commenting anything on merits and demerits of the case, I deem it proper to allow these bail applications.
6. These bail applications are accordingly allowed and it is
directed that accused-petitioners (1) Pushpendra Kumar @ Pussu S/o Nahar Singh Meena, (2) Deshraj Meena @ Golu S/o Mohar Singh Meena, (3) Rupsingh Yogi @ Rupi S/o Shree Teekaram Yogi, (4) Priyanka Kumari Meena D/o Hanuman Meena, (5) Pawan Meena @ Mintu S/o Rajuram Meena, (6) Naresh Kumar Yogi @ Rajendra @ Shootar S/o
[2025:RJ-JP:4341] (4 of 4) [CRLMB-15580/2024] Shri Hukamchand Yogi, shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
