Union of India represented by its Secretary, Department of Science and Technology, 2nd Floor Vishwakarma Bhawan, Shaheed Jeet Singh Marg, New Delhi-110016 ...Applicants - Versus - Shri.Rakesh Kumar Sarmah, R/o Survey of India Campus, Barik Point, Shillong 793001 ...Opp. Party/Respondent Coram: Hon’ble Mr. Justice I.P. Mukerji, Chief Justice Hon’ble Mr. Justice W. Diengdoh, Judge Appearance: For the Applicants : Dr. N. Mozika, DSGI with Ms. K. Gurung, Adv. For the Respondent : Ms. R.P.N. Marak, Adv. vice Mrs. P.D. Bujarburuah, Sr. Adv. Serial No. 06 Daily List 2025:MLHC:205-DB Learned counsel for the respondent opposes the Section 5 application and seeks extension of time to file an affidavit-in- opposition. In our opinion, granting time to file an affidavit-in- opposition would only delay the matter. The issue involved here is similar to the connected appeals being MC(WA) No. 35 of 2025, MC(WA) No. 36 of 2025 and MC(WA) No. 38 of 2025. The delay in this appeal in terms of cause of delay or the number of days is the same as the other appeals in which the delay has been condoned. We see no reason to treat this matter separately, hence, we allow the application [MC(WA) No. 37 of 2025] by condoning the delay of 306 days and direct the Registry to register the appeal. As the respondent is represented by learned counsel, we expedite hearing the appeal dispensing with all formalities. Advocate-on-Record for the appellants shall file an informal paper-book in this Court by 7th April, 2025 serving a copy thereof on the Advocate-on-Record for the respondent at least seven days before the date fixed for hearing of the appeal. List the appeal for hearing on 16th April, 2025. (W. Diengdoh) (I.P. Mukerji) Judge Chief Justice 2025:MLHC:205-DB Digitally signed by SYLVANA LIZ KHARBHIH Date: 2025.03.24 17:57:44 IST
