01. Record reveals that the instant petition was listed on 23.09.2011 and the last date of hearing in the instant petition was fixed on 07.12.2012 and the instant petition has come up before this Court after 13 years and during this intervening period, there was no effort being made on the part of the petitioners to get the petition listed, thus, an inference can be drawn that the petitioners do not want to prosecute the instant petition.
02. Today also, when the instant petition was taken up, there is no representation on behalf of the petitioners. Even otherwise also, learned counsel for the respondents submits that the relief which has been prayed for by the petitioners cannot be acceded to at this stage as they were engaged on contractual basis and the period of contract is over since long, and thus, they cannot be allowed to continue at this stage.
03. In the aforesaid backdrop, no fruitful purpose will be served by keeping this petition pending and the same is, accordingly, dismissed for non- prosecution.
