The Court made the following ORDER:
1. This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:
“to issue a writ, order, or direction more particularly one in the nature of writ of mandamus
declaring the action of the respondents in including the private patta land of the petitioners with an extent of Ac. 1.60 cents each in SY.No 734 of Pedaganjam village, Bapatla District in prohibited list without assailing any reasons is illegal, arbitrary, violation of article 14,16,21 and 300A of the constitution of India and consequently direct the respondents to delete the private patta lands of the petitioners with an extent of Ac. 1.60 cents each in SY.No 734 of Pedaganjam village from the prohibited list and also pass…”
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondent Nos. 1 to 5. 3. The case of the petitioners is that the petitioners are the absolute owners and possessors of the subject land admeasuring an extent of Ac.3.20 cents in Sy.No.734 of Pedaganjam Village, Bapatla District, having acquired the said property as their ancestral property, being the legal heirs of the original owners. While things stood thus, when the petitioners intended to sell the subject property, they came to know that the said property had been included in the prohibitory list under Section 22-A of the Registration Act, 1908. 4.
The learned counsel for the petitioners submits that the petitioners submitted applications/representations dated 24.04.2025 through Mee- Seva to the respondent authorities, seeking deletion of the subject property from the list of prohibited properties under Sections 22-A(1)(e) and 22- A(1)(a) of the Registration Act, 1908. Even after receipt of the said applications dated 24.04.2025, the respondent authorities have neither considered the same nor issued any proceedings till date. Hence, the present Writ Petition. 5. On the other hand, the learned Assistant Government Pleader for Revenue appearing for the respondents submits that, the respondent authorities will consider the applications made by the petitioners dated 24.04.2025 and pass appropriate orders in accordance with law within a reasonable time. 6. Having regard to the submissions made by the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents, and on perusal of the material available on record, this Court is of the considered view that the present writ petition can be disposed of by directing the respondent authorities to consider the applications/representations of petitioners dated 24.04.2025, for deletion of the subject property from the prohibited list notified under Section 22- A(1)(E) and 22-A(1)(A of the Registration Act, 1908 as expeditiously as possible, strictly in accordance with the law, preferably within a period of
four (04) months from the date of receipt of this order. It is needless to mention that the respondent authorities shall conduct a necessary inquiry by hearing all the concerned parties. 7. With the above direction the writ petition is disposed of. No order as to costs.
