PUBLIC PROSECUTOR The Court made the following: ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioners herein/A1 and A2, seeking regular bail in connection with Crime No.89 of 2024 of Moothugudem Police Station, Alluri Sitharama District, registered for the offences punishable under Sections 8 (c) r/w 20(b)(ii)(C) of the NDPS Act. 2. Brief facts of the case are that, on 13.12.2024, at about 6.30 p receipt of credible information, the SI of Police, Mothugudem Police Station along with his staff while conducting vehicle check in the presence of mediators, police found A1 and A2, who tried to three plastic bags in Nissan Terrano Car from Kalimela, Maharashtra State illegally. The Police apprehended A1 kgs of Ganja, Nissan Terrano Car and two touch A1 and A2, under the been registered against the accused. .m., on transport 56 kgs of Ganja in Odisha State to and A2 and seized 56 pads from the possession of cover of mediators report. Learned counsel for the petitioners would submit that the petitioners have been in judicial custody since 13.12.2024 and most of the investigation completed and prays to allow the criminal petition. 5. Contra to the same, learned Assistant Public Prosecutor vehemently opposed the petition stating that the investigation is pending for RFSL report and the seized contraband is huge quantity and prays to dismiss the criminal petition. 6. Considering the submissions made and record shows that, the petitioners on perusal of the material on were arrested and remanded to judicial 3 custody on 13.12.2024 and the contraband involved in the present case is 56 kgs which is commercial quantity and in view of the bar contained under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioners at this stage. 7.
