...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an appropriate writ or order or a direction more particularly one in the nature of writ of MANDAMUS declaring the action of the respondents in not releasing the admitted bill amount of Rs.4,35,96,677/- even after finalized the bill payable to the petitioner after successful execution of work for Modernization of Romperu Right Arm from KM 24.400 to KM30.450 vide its Agreement.No.13 SE/2018-19, Dt.02.05.2018 in Water Resources Department, in Irrigation Circle, Guntur, Drainage Division, Repalle, as is illegal, arbitrary and violative of Articles 14, 21 and 300-A of the Constitution of India and also violative of principles of natural justice, consequently direct the respondents to release the payment of Rs.4,35,96,677/- due to the petitioner in respect of execution of work forthwith interest of 18percent and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased direct the respondents to release the payment of Rs.4,35,96,677/- in respect of execution of work for “Modernization of Romperu Right Arm from KM 24.400 to KM30.450 vide its Agreement.No.13 SE/2018-19, Dt.02.05.2018 in Water Resources Department, in Irrigation Circle, Guntur, Drainage Division Repalle, immediately, pending disposal of the main writ petition and to pass Counsel for the Petitioner:

ORDER:
The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“….to issue an appropriate writ or order or a direction more particularly one in the nature of writ of MANDAMUS declaring the action of the respondents in not releasing the admitted bill amount of Rs.4,35,96,677/- even after finalized the bill payable to the petitioner after successful execution of work for Modernization of Romperu Right Arm from KM 24.400 to KM30.450 vide its
Agreement.No.13 SE/2018-19, Dt.02.05.2018 in Water Resources Department, in Irrigation Circle, Guntur, Drainage Division, Repalle, as is illegal, arbitrary and violative of Articles 14, 21 and 300-A of the Constitution of India and also violative of principles of natural justice, consequently direct the respondents to release the payment of Rs.4,35,96,677/- due to the petitioner in respect of execution of work forthwith interest of 18percent and to pass….”

The present writ petition is filed by the petitioner aggrieved by the action of the respondent authorities in not releasing an amount of Rs.4,35,96,677/- to the petitioner for completing the work of ‘Modernization of Romperu Right Arm from KM 24.400 to KM 30.450’ as per the agreement No.13 SE/2018-19, dated 02.05.2018 entered with the Irrigation department.
3. Heard Sri. Battula Sanjaiah Gandhi, learned counsel for the petitioner and learned Assistant Government Pleader for Irrigation.
4. Today when the writ petition came up for hearing, learned Assistant Government Pleader has furnished a copy of the letter addressed by the Executive Engineer, Drainage Division, Repalle dated 11.11.2025, wherein it is

stated that an amount of Rs.4,75,14,765/- was paid to the petitioner vide token No.2025-703002 and vide RBISN62025093032548245, dated 30.09.2025.
Learned counsel for the petitioner has also admitted that the amounts were paid to the petitioner.
5. In view of the fact that the amount payable to the petitioner was already paid on 30.09.2025, this Court is of the opinion that no further orders are necessary in the present writ petition.
6. Accordingly, this writ petition is closed. There shall be no order as to costs.
Consequently, pending Miscellaneous Petitions, if any, shall stand closed. ______________________
