petitioner to start is Bio-Deisel Retail Outlet in an extent of Acres 0.67 cents at Sy.No.73/2, 73/3, Silagam Village, Kaviti Mandal, Srikakulam District as wholly arbitrary, unjust besides being violative of the fundamental rights guaranteed to the petitioners under Articles 14 and 19(1)(g) of Constitution of India and pass IA NO: 1 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the 2nd respondent to consider the application of the petitioner for grant of the Registration Certificate ( Form III) to its Bio-Deisel Retail Outlet in an extent of Acres 0.67 cents at Sy.No.73/2, 73/3, Silagam Village, Kaviti Mandal, Srikakulam District without reference to the issuance of the Environmental Clearance and pass IA NO: 2 OF 2022 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to permit the petitioner to implead the Andhra Pradesh Pollution Control Board, Regional Office, Purushotam nagar Colony, Gujarathipeta, Srikakulam, rep by Environmental Engineer as a proposed respondent/Respondent No.3 in the present writ petition and pass Counsel for the Petitioner:

The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“… to issue an appropriate writ order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the 2nd respondent in issuing the Registration Certificate ( Form III) to enable the petitioner to start is Bio-Deisel Retail Outlet in an extent of Acres 0.67 cents at Sy.No.73/2, 73/3, Silagam Village, Kaviti Mandal, Srikakulam District as wholly arbitrary, unjust besides being violative of the fundamental rights guaranteed to the petitioners ….”

When the writ petition came up for admission on 14.12.2022, this Court passed an interim order directing the 2nd respondent to consider the petitioner’s application for grant of a Registration Certificate (Form III) for its Bio-Diesel Retail Outlet in an extent of Ac-0.67 cents in Sy.No.73/2, 73/3, Silagam Village, Kaviti Mandal, Srikakulam District. 3. Today, when the mater came up for hearing, learned counsel for the petitioner has stated that, in view of the interim order dated 14.12.2022 granted by this court, no further cause survives in this writ petition. 4. Recording the same, this Writ Petition is closed. There shall be no order as to costs. As a sequel, Interlocutory Applications pending, if any, shall stand closed __________________ JUSTICE V.SUJATHA
