This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... to issue an order, direction, or Writ more particularly one in the nature of Writ of Mandamus aggrieved by the unfair and partial action of the Respondents in neither taking any action pursuant to the representations of the Petitioners on various dates nor registering any FIR against one Constable Murali (P.C No. 26) under the appropriate provisions of Bharatiya Nyaya Sanhita, 2023 including but not limited to Sections 109, 117 and 124 as the same is being illegal, arbitrary, violative to the principles of natural justice and Article 14, 19 and 21 of the

Indian Constitution and consequently, direct the Respondents to register a FIR on the file of Respondent No.5 against the Accused.”
2. Heard Sri SVM Sankar, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home would submit that the DSP conducted enquiry against the accused in the matter who is the head constable, nothing is found against him that is why they have not registered the case on the representation of the petitioner. 4. Recording the said submissions, the Writ Petition is disposed of. However, the petitioner is at liberty to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
