06 / 17.09.2025: The writ petition relates to payment of family pension which has not been paid to the petitioner. She is claiming family pension after death of her husband- Jitendra Shukla. There is a discrepancy in the name of this petitioner as the petitioner is known as Nira Devi, but her name in the pension book has been mentioned as Nirawati Shukla. Because of this discrepancy, she has not been paid the family pension.
2. In the counter affidavit, it has been stated that if the petitioner files a fresh representation, her case will be considered after examining the issue.
3. Considering the said submission, I direct the petitioner to file a representation annexing all the documents in her favour. She will also file an indemnity bond stating therein that in future if any rival claim is raised by any person and if the claim is found to be genuine, this petitioner will indemnify the employer.
4. On receipt of the representation and the documents, the respondents will adjudicate the claim of the petitioner and thereafter
will forward the same to the Accountant General and will ensure payment to the petitioner including the arrears. The application should be filed within four weeks and the entire process should be concluded within twelve weeks thereafter. If the claim of the petitioner is rejected, the reasons thereof should also be communicated to the petitioner.
5. If it is found that Nirawati Shukla and this Nira Devi are the same person, in the opinion of this Court, there should be no impediment in disbursing the amount to the petitioner.
6. With the aforesaid observations and directions, the instant writ petition stands disposed of.
