Kishore 2 C.Borcar and Another, 2025 SCC OnLine SC2069, wherein it has been held that there shall be no requirement to issue summons to the accused in terms of Section 223 of BNSS at the pre-cognizance stage. 2. Counsel for the respondent has no objection to the above proposition. 3. In view of the aforesaid submission and considering the law laid down by the Apex Court as well as the request made by the counsel for the petitioner, the present petition stands dismissed as withdrawn. 4.
