WRIT PETITION NO. 28207 of 2025 ORDER:
Succinctly, the case of the petitioners is that the respondent authorities are interfering with the possession of the petitioners’ land to lay the road in the land belongs to them in Survey No.965 to an extent of Ac.2.50 cents of Belupalli Village and Sy.No.413/1 to an extent of Ac.1.26 cents of Peddachellarigunta Village, Baireddipalle Mandal, Chittoor District, without following the due process of law. As per the revenue records, the petitioners are in possession of the subject land and they are raising mango trees in the subject land and seeking a direction to the respondents not to interfere with the possession of the petitioner’s property without following the due process of law. 2. The learned Assistant Government Pleader has placed the written instructions in Roc:A/148/2025, dated 13.10.2025 of the 4th respondent/Tahsildar, Baireddipalle Mandal (part of the record) and the said written instructions indicates that the lands in Sy.No.965 of Belupalli Village and Sy.No.413/1 of Peddachellarigunta Village are DKT (assigned) lands, not private patta lands. The 15 feet cart track condition is a statutory obligation under the DKT assignment rules and the respondent authorities have no intention to dispossess the petitioners from their assigned lands without following the due legal procedure. 4

In view of the above said circumstances, this Court deems it appropriate to dispose of this writ petition directing the respondents, if at all, they required the land for any public purpose, the respondents shall follow the due process of law. 4. With the above said direction, the Writ Petition is disposed of. There shall be no order as to costs.
