This application is filed jointly on behalf of the Plaintiffs and Defendants under Order XXIII Rule 3 read with Section 151 CPC for recording of settlement between the parties. 2. Present suit was instituted by the Plaintiffs inter alia seeking a decree of permanent injunction restraining the Defendants and all others acting on their behalf from manufacturing, marketing, supplying, selling and offering for sale any electronic goods and/or home appliances including but not limited to televisions (LED or otherwise), air conditioners (including split, window and tower ACs), industrial coolers, washing machines, storage water heaters, earpods, smart watches etc. under the impugned marks TLC/TLC India/ / and/or any other mark deceptively This is a digitally signed order. During the pendency of the suit, parties have settled their inter se disputes amicably and terms of settlement are incorporated in paragraph 4 of the application. 4. Court has perused the terms of settlement and finds the same to be lawful. Accordingly, this application is allowed and disposed of, recording the settlement between the parties. CS(COMM) 712/2025 5. As agreed between the parties, this suit is decreed in favour of the Plaintiffs and against the Defendants as per paragraph 48(a) and (b) of the plaint. Plaintiffs have agreed to forego their claims for rendition of accounts/damages, as prayed in paragraph 48(e) of the plaint. The settlement terms shall form part of the decree and bind the parties thereto. 6. Registry is directed to draw up the decree sheet. 7. Suit stands disposed of. 8. Plaintiffs are held entitled to refund of entire court fees in accordance with the Court Fees Act, 1870. 9. Date of 15.09.2026 stands cancelled.
