Heard Shri Manish Dwivedi, learned counsel for the petitioner and Shri Sarveshwar Lal Srivastava, learned counsel for the respondent UPSRTC. The counter affidavit asserts that the petitioner was charged for carrying passengers without tickets. According to the counter affidavit the charges were proved against the petitioner in the enquiry proceedings. A show cause notice was issued to the petitioner after the inquiry proceedings had indicted him. The petitioner submitted a reply to the show cause notice. After due consideration of the aforesaid reply of the petitioner the petitioner was dismissed from service by the impugned order. Perusal of the writ petition shows that no pleadings as regards any illegality in the enquiry proceedings have been taken. Hence it does not lie in the mouth of the learned counsel to contend that the enquiry was vitiated. There is no perversity in the impugned order.
