Hon'ble Shri Justice Sachin Singh Rajput Order On Board 04/11/2025
1. The present writ petition has been filed by the petitioner with the
2 following prayer:
“I. This Hon’ble court may be kind enough to call for the records of the instant matter. ii. This Hon’ble Court may be kind enough to quash/set-aside the impugned communication dated 08.01.2021(AnnexureP/1). Iii. This Hon’ble Court may be kind enough to issue a writ, order or direction to direct the respondent authorities to grant the petitioner an opportunity to clear the defect. iv. This Hon’ble Court may be kind enough to direct the respondent Commission and its concerned authorities to act upon the representation submitted by the petitioner. v. This Hon’ble Court may be pleased to pass any other order as it deems fit, in the interest of justice.”

Learned counsel for the petitioner submits that the petitioner has applied against recruitment notice issued by the respondent Commission for the posts of Constable (General Duty) in Border Security Force (BSF), Central Industrial Security Force (CISF), Central Reserve Police Force (CRPF), National Investigation Agency (NIA) and Secretariat Security Force (SSF) and Rifleman (General Duty) in Assam Rifles, as per the Recruitment Scheme Formulated by the Ministry of Hoe Affairs through Staff Selection Commission. The petitioner mentioned himself to be a resident of District Balod whereas the documents which the petitioner submitted reflected him to be a resident of District Durg.
The petitioner cleared the written test, the physical evaluation and also the detailed medical examination conducted by the respondent Commission, but on scrutiny of documents, the candidature of the petitioner was unilaterally cancelled due to mismatch in the aforementioned details. The petitioner was not afforded an opportunity to present his case or to rectify the defects causing a gross violation of the Principles of natural justice. The petitioner also moved
3 representations before the concerned authorities which have not been paid hhd to, which demonstrates abuse and arbitrary exercise of poser. Hence this petition. 3. Learned counsel for the respondents submits that case of the petitioner has been considered by the respondents authorities and the reply in this regard has also been filed by the respondent. 4. I have heard learned counsel for the parties and perused the material available on record. 5. For ready reference paragraph 9 and 10 of the reply filed by the respondents is required to be quoted below:-
“9. That, after observing all due formalities, the petitioner is found fit in DME. Accordingly, DIG (Rectt) Directorate General, CRPF, New Delhi has submitted proposal alongwith Documents Checking and verification sheet, Medical Booklet and Medical Examination Report of the petitioner to the Director, Staff Selection Commission, HQ, CGO Complex, New Delhi with request to revise result of petitioner vide letter No. A.VI- 1020/2018-Rectt(SSB)CT/GD-2018 dated 26/10/2022. A copy of DIG (Rectt) Directrorate General, CRPF, New Delhi letter No. A.VI-1020/2018-Rectt(SSB) CT/GD-208 dated 26/10/2022 is annexed herewith as Annexure-7. 10. That, it is respectfully submitted that the reliefs sought by the petitioner in the instant writ petition has been addressed by the respondents. Therefore, instant Writ Petition has become infructuous. 6. In view of the steps taken by the respondents, the grievance of the
4 petitioner has already been resolved therefore, nothing survives for adjudication before this Court. Thus, this writ petition is disposed of reserving liberty in favour of the petitioner to revive the same in case of any cause of action still survives. 7. Accordingly, the writ petition is disposed of. Sd/-
