The present application u/s 528 of BNSS of 2023 has been filed with a prayer to direct the court concerned to take coercive action against the opposite party no. 2 to deposit the balance dues since 2013 in pursuance to the proceeding of the Case No. 309 of 2019 (Akhilesh vs. Indrajeet), under Section 128 Cr.P.C., P.S. Quarsi, District Aligarh, pending in the court of Additional Principal Judge/Family Court, Court No. 1, Aligarh within stipulated period. After some arguments, learned counsel for the applicants does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicants after retaining a photocopy of the same.
