This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.129/2025 registered at Police Station As per FIR registered at Civil Lines Raipur, investigated by Cyber Range Raipur, District -Raipur (CG) for the offence punishable under Sections 317(2), 317(4), 317(5), 111 & 3(5) of B. N. S. 2023. 2. Case of the prosecution, in brief, is that an information was received at GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.11.27 18:48:30 +0530 2 police station Civil Lines Raipur, whereby on 23.03.2025 upon considering the information received from Cyber Range Police Station Raipur for actions against the mule account holders through the coordination portal operated by Home Ministry, Government of India, prima facie crime U/s 317(2), 317(4), 317(5), 111 & 3(5) of B.N.S. 2023 was found to have been committed, therefore the crime was registered and was taken up for investigation. The information reflects in the Coordination Portal of the Indian Cyber Crime Coordination Center which is operated by the Home Ministry, Government of India, which is a comprehensive guide for sharing information as to Cyber Crime for the purpose of investigation by the Police, upon receiving such information of the mule account which is being used for disbursing, utilizing and enriching the amount obtained from the Cyber Fraud, therefore such information related to Cyber Fraud was collected from the Coordination Portal, in which a total of 128 Bank Accounts of the Bank Of Maharashtra Raipur Branch were found to have deposits of Rs.64,10,855/- till 11.01.2025, which had been obtained by way of Cyber Fraud. Upon receiving the said information and having reason to believe that the amount is being used, concealed or disposed for the purpose of Cyber Fraud with respect to the aforesaid bank accounts, the offence was registered and taken up for investigation. 3. Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. He would submit that no seizure has been made from the present applicant and he has only being used as scapegoat in the present case and no evidence has been collected from the present applicant's phone which reflects the applicant participation in the overt act. He would submit that the 3 present applicant has been falsely implicated in the present crime and he had no knowledge whatsoever with his identity and personal information being used for unlawful activities. He would submit that the applicant's credential were used by one Bharat Mandhani resident of Devpuri for the purpose of opening of Bank Account at the Bank of Maharashtra situated at Mova Raipur bearing IFSC Code MAHB0002335 and Account No. 60491420007 by using the information of the applicant the said bank account was opened and mobile no. 9039733009 was registered with the Bank, which was not used by the applicant. He would submit that as per the allegations upon the present applicant he got Rs. 4000/- in lieu of the account opened in his name and the account kit lies with the One Bharat Mandhani. He would submit that the police authorities have not recovered any incriminating evidences from the applicant's phone and that no information as to the mule account reflects which has been conducted from the applicant’s phone. He would submit that charge sheet has been filed, the applicant is in jail since 27/03/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and he would submit that charge sheet has been filed in this case. He would submit that bail application of the co-accused persons namely Rajesh Mandhani in MCRC No.8661/2025 on 31/10/2025, Sanjay Jaswani in MCRC No.8228/2025 on 17/11/2025, Rohit Kasturiya in MCRC No.9209/2025 on 17/11/2025, Smt. Jyoti Mishra in MCRC No.8633/2025 on 31/10/2025, Bhupendra Singh Dhunna @ Captain Singh in MCRC No.9441/2025 on 21/11/2025 & Nikhil Chawala in 4 MCRC No.9330/2025 on 19/11/2025 have been rejected by this Court, therefore applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, nature of allegation levelled against the applicant, further the fact that bail application of the co-accused persons namely Rajesh Mandhani in MCRC No.8661/2025 on 31/10/2025, Sanjay Jaswani in MCRC No.8228/2025 on 17/11/2025, Rohit Kasturiya in MCRC No.9209/2025 on 17/11/2025, Smt. Jyoti Mishra in MCRC No.8633/2025 on 31/10/2025, Bhupendra Singh Dhunna @ Captain Singh in MCRC No.9441/2025 on 21/11/2025 & Nikhil Chawala in MCRC No.9330/2025 on 19/11/2025 have been rejected by this Court, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Manoj Jangde @ Jagid involved in Crime No.129/2025 registered at Police Station As per FIR registered at Civil Lines Raipur, investigated by Cyber Range Raipur, District -Raipur (CG) for the offence punishable under Sections 317(2), 317(4), 317(5), 111 & 3(5) of B.
