1. Heard on the application filed under Section 483 of B.N.S.S. This is first bail application before this Court filed by the applicants for grant of regular bail. The applicants have been arrested on 18.09.2024 in connection with Crime No. 20/2024 registered at P.S. 2 Dantewada (CG) for the offence under Sections 191, 190, 03, 296, 351 of BNS and Section 04 & 05 of Tonahi Pratadna Adhiniyam. 2. The case of the prosecution is that on 15.09.2025, 5 deceased persons have been murdered by the accused persons by causing injuries to them on the ground that the deceased persons have engaged in playing witch- crafts and the entire village is affected by their act. The FIR has been registered and during investigation it comes that the present applicants have pointed to the villagers that the deceased persons are engaged in playing witch-crafts on which the villagers have committed their murder. The applicants have been arrested on 18.09.2024 and charge-sheet has been filed. 3. Learned counsel for the applicants would submit that the present applicants are not named in the FIR. There is no legally admissible evidence against them that they are also engaged in committing murder of five deceased persons. The trial of the case in not in considerable stage and till date only 8 witnesses have been examined. The applicants are in jail since 18.09.2024 and final adjudication will take its own time, therefore, the applicants may be enlarged on bail. 4.
On the other hand, learned counsel for the State opposes and has submitted that from the statement of the witnesses it comes that the present applicants have pointed towards the deceased persons that they are engaged in playing witch-craft and on their instance, the villagers have committed murder of five deceased persons and looking to the gravity of offence and nature of evidence collected during the investigation, the applicants are not entitled for bail. 3
5. I have heard learned counsel for the parties and perused the case diary as well as document annexed with the bail application. 6. Considering the submissions made by learned counsel for the parties, considering the nature of offence and material collected during the investigation, further considering the gravity of offence in which five persons have lost their lives, the trial of the case has already been commenced and 08 witnesses have already been examined before the learned trial Court, I am not inclined to release the applicants on bail. 7. Consequently, this application filed by the applicants Keekara Ramesh and Sunnam Rama under Section 483 of B.N.S.S. for grant of regular bail is hereby rejected. Sd/- (Ravindra Kumar Agrawal) Judge
