01. Vide impugned order dated 17.06.2023, passed by learned Special Judge, Fast Track Court (POCSO Cases), Jammu, [“the trial Court”], respondent was admitted to interim bail in case titled ‘Shanker Singh through his Mother Samriti Devi V. UT of J&K through SHO P/S Bagh-e-Bahu, Jammu’ for offences under Sections 366-A, 342, 344 IPC; 4/6/16 of POCSO Act and 5/6/7/18 of Immoral Trafficking Prevention Act.
02. The petitioner-UT is aggrieved of the impugned order, primarily, on the ground of gravity of the charge. The petitioner-UT, instead of approaching the trial Court for cancellation of bail has straightway invoked revisional jurisdiction of this Court for cancellation of bail against the interim order which is not maintainable. Hence, the present petition is dismissed with liberty to the petitioner to approach the trial Court and avail the appropriate remedy under law.
