After arguing at length, learned State Counsel made an objection and submitted that the ground as raised in this writ petition is not available to petitioner and on further request being made by advocate of District Bar Association proposal for reconstruction of the Court building is re-considered by the Competent Authority and as per his information it is proposed to be constructed including land on which the Residential Accommodation/Gulab Colony was constructed. He also pointed out that 13 employees residing in the said colony, 08 have already vacated the accommodation after issuance of notice by the Competent Authority for vacating residential accommodation. Except the petitioner other remaining have also given assurance that they will vacate the houses within shortest period of time. He also made a submission that on the information gathered by him, petitioner is having her own house within a very short distance from present place of residence. 2. After arguing for some time on merits of case, counsel for petitioner submits that as this Court is not inclined to grant relief as prayed for by petitioner, at least petitioner may be granted a month’s time to vacate the Govt. accommodation, subject matter of this writ petition. 3. Heard learned counsel for the respective parties and perused the documents enclosed along with this writ petition. 4.
Perusal of documents enclosed along with this writ petition and the order dated 04.11.2025 under challenge, would show that order Annexure P-1 is passed by competent authority under Chhattisgarh Lok Parisar (Bedakhli) Adhiniyam, 1974. During course of argument, counsel for petitioner has not made any submission on merits of the claim challenging the order of competent authority under the Adhiniyam 1974, however, submission is made that land on which the residential complex is constructed and in which petitioner is residing, is now not needed for construction of Civil Court building because alternate land has been identified for construction of Civil Court. 3 Competent Authority while passing order of eviction from said Govt. residential accommodation considered that the land of Gulab Colony is to be handed over to the Principal District And Sessions Judge, Ambikapur. Submission of the State is that other land identified initially for construction of the Civil Court was objected by advocates of the District Bar Association and their objection was considered by the Competent Authority and now construction of Civil Court building at Ambikapur is proposed on the land including the land of Gulab Colony on which Government accommodation are constructed. Most of the person’s occupying Govt. accommodation have vacated and some have given assurance to vacate the house. 5. In the aforementioned facts of the case, I do not find any merit in this writ petition, accordingly, writ petition is dismissed. However, considering the submission of counsel for petitioner that petitioner may be granted one month time to vacate subject Government accommodation, keeping in mind that petitioner is a Government servant and may be residing along with her family members, limited prayer is allowed.
