CORAM:
HON'BLE MR. JUSTICE ANOOP CHITKARA Present: Mr. Pardhuman Garg, Advocate and Mr. Kanav Goyal, Advocate, for the peoner. Ms. Navreet Kaur Barnala, AAG, Punjab. **** ANOOP CHITKARA, J. (ORAL) The present peon has been filed under Secon 482 BNSS, 2023 read with Secon 528 of BNSS, 2023 for seeking Blanket Ancipatory bail with a further prayer for issuance of direcons to respondents to serve 15 days prior noce to the peoner.
2. To substanate his submissions, he has cited a judgment passed by a co- ordinate Bench of this Court in Sukhdev Singh Versus State of Punjab and others, CRM-M- 31442-2021, decided on 12.10.2021.
3. A perusal of the aforesaid judgment clearly reflects that in that case the relief was granted in a specific context as allegaon was against police official for pressurising to pay Rs.1,90,000/-, as such, co-ordinate Bench of this Court directed that if any FIR is registered for an amount of Rs.1,90,000/- to be recovered from the peoner (Sukhdev Singh), in that case, seven days advance noce would be given. Thus, on the facts and law, the said judicial precedents does not apply to the case of peoner. The law is se;led that a blanket bail cannot be granted, as such, present peon is liable to be dismissed.
4. At this stage, counsel for the peoner submits that he be permi;ed to make a representaon to the concerned Senior Superintendent of Police. JYOTI 2025.05.07 09:31 I attest to the accuracy and integrity of this
order/judgment.
