GP FOR PANCHAYAT RAJ RURAL DEV 2 The Court made the following order:- It is asserted in paragraph No.3 at running page No.8 of the writ affidavit, that after the death of the petitioner’s father, the petitioner has been in possession and enjoyment of the properties along with his mother, without any disputes to other villagers. Thereafter, respondent Nos.4 to 6 without any documents trespassed into the petitioner’s land and constructed houses in collusion with 7th respondent. The 7th respondent is the petitioner’s uncle and he has no right in subject properties and creating nominal deeds in favour of respondent Nos.4 to 6 and others and creating troubles to the petitioner. 2. As seen from the assertions made in the affidavit, it clear that it is purely a civil dispute between the petitioner and the respondent Nos.4 to 7. 3. At this juncture, after arguing for sometime, learned counsel for the petitioner sought permission/leave of this Court for withdrawal of the writ petition and liberty may be granted to avail alternative remedy. The learned counsel endorsed the same on the bundle. 4. Permission is accorded. 3 5. Accordingly, the present Writ Petition is dismissed as withdrawn and liberty is granted, as prayed for. There shall be no order as to costs.
