2 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to permit the petitioner herein to amend the prayer in WP.No.14746 of 2018 as; "Declaring the inaction of the 2nd Respondent in passing the orders vide Cr.No.7529/2017/CPE/E2, dated 09-04-2018, is illegal, arbitrary, violation of principles of natural justice and also violative of Art. 14, 21, 300-A of Constitution of India and consequently direct the respondents to forthwith take necessary action pursuant to the grant of licence to the petitioner by adjusting the amount of Rs.2 lakhs, as licence fee, which was deposited by the petitioner earlier, vide challan dated 25-01-2016, No.0000025531 at SBI, Anakapalle branch, under the application dated 31-12-2015" Instead of "declaring the inaction of the 2nd Respondent in passing the orders vide Cr.No.7529/2017/CPE/E2, dated 09-04-2018, is illegal, arbitrary, violation of principles of natural justice and also violative of Art. 14, 21, 300-A of Constitution of India and consequently direct the respondents to release the licence fee of Rs.2 lakhs besides the damages of Rs.60,00,000/- and also the rents so far paid by the petitioner.
