JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 3 03-09-2025 Heard learned counsels for the petitioners and learned APPs for the State. 2. The petitioners have prayed for regular bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 325, 324, 307, 379, 504 and 506 of the Indian Penal Code, later on Section 302 of the Indian Penal Code was added. 3. The case of the prosecution in short is that while the uncle of the informant was irrigating the land, the accused persons including these petitioners abused and assaulted in the presence of co-villagers.
As they were going to make complain before Jhajha Police Station, it is alleged that accused persons again assaulted informant’s side. Co-accused Bodhan Yadav and Saurabh Yadav (Petitioner no.1 in Cr.Misc. Case No. 39613 of 2025) snatched Rs.25,000/- and gold chain of Vijay Yadav. 4. Learned counsel for the petitioners have submitted that from the perusal of FIR it is clear that the nature of allegation is general and omnibus and there is no specific allegation against any of the petitioners. It has also been submitted that similarly situated co-accused has been granted
Patna High Court CR. MISC. No.38943 of 2025(3) dt.03-09-2025 3/3 bail by the learned Co-ordinate Bench vide Cr. Misc. Case No. 51248 of 2024 dated 11.11.2024 and the case of these petitioners stands on similar footing. 5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioners but conceded that the co-accused has been granted bail by the learned Co-ordinate Bench. 6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Jhajha P.S. Case No. 100 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each of them with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui. durgesh/- (Ashok Kumar Pandey, J) U T
