ORDER:-
Heard the learned counsel for the petitioners, the learned Assistant Government Pleader for the respondent Nos.1, 3 to 5 and the learned Standing Counsel for the 2nd respondent.
2. In spite of service of notice, none appears for the respondent Nos. 6 and 7.
3. This writ petition was filed questioning the action of the respondents in not paying the compensation to the petitioners land in Sy.No.259-5 to an extent of Ac.4-50 cents situated at Vadigepalli village of Gorantal Mandal, Ananthapuramu District.
4. The learned counsel for the petitioners submits that though the petitioners are identified as the legal heirs of the original assignee, late K.Rangappa, the ex-gratia amount was not paid by the respondent Nos.3 to 5.

On the other hand, the learned Assistant Government Pleader, relying upon the 5th respondent, submits that the father of the petitioners, Mr.K.Rangappa, was granted D-Form Patta for an extent of Ac.4-50 cents of Sy.No.259-5 of Vadigepalli village vide proceedings dated 06.05.1970. The following are the legal heirs of the assignee late Mr.K.Rangappa who were apportioned exgratia for the subject land as per P.V.Statement approved:-

The Pattadar pass books were obtained by K.Sreeramulu, s/o.Gollanna and K.Chinnaroddappa s/o.Gollanna, the grand sons of the assignee, vide I- B.Khata Nos.880, 881 against which the writ petitioners filed petition for cancellation of pass books before the 3rd respondent for cancelling the 1-B issued to the subject land. The 3rd respondent has dismissed the appeal vide proceedings dated 31.03.2022. Thus, the two groups of legal heirs of the assignee are at loggerheads over the apportionment of subject land/ex-gratia and as such, it could not be disbursed to the petitioners and other legal heirs as there is no consensus among them.
7. In view of the above said facts and circumstances, the petitioners are
directed to approach the 3rd respondent seeking the release of exgratia amount for the subject land as determined with an apportionment amongst the petitioners by enclosing all the necessary documents in support of their claim within a period of four (04) weeks, from the date of receipt of this order. On
receipt of the same, the 3rd respondent is directed to issue notices to the unofficial respondents and the other legal heirs of the original assignee of late K.Rangappa to submit their case for release of their share of the ex-gratia amount and shall conduct necessary enquiry to decide the apportionment of ex-gratia amount amongst the eligible heirs of the original assignee of the subject land which was acquired and handed over to the APS in the acquisition process, and after giving due opportunity of hearing to all the parties concerned and upon verification of the records, final decision shall be taken on it as expeditiously as possible preferably within a period of two (02) months thereafter.
8. Accordingly, the Writ Petition is disposed of. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
As a sequel, Interlocutory Applications pending, if any, shall stand closed.
