PUBLIC PROSECUTOR The Court made the following: ORDER: Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023^ by the Petitioner/Accused No.2 for granting of pre-arrest bail in connection with Crime No.583 of 2025 of P.M Palem Police Station, Visakhapatnam Commissionerate, Visakhapatnam, registered for the alleged offences punishable under Sections 318(4) read with 3(5) of the ’ the BNSS
, 2 Bharatiya Nyaya Sanhita, 2023^ and 21(1)(2)(3) of the Banning of Unregulated Deposit Schemes Act, 2019^. Heard the learned Counsel for the Petitioner and the learned Assistant
2. Public Prosecutor. As seen from the record, the petitioner is working as an AR Head Constable in Anakapalli District.
It is alleged that he, along with the other accused, has been conducting chit business. The police registered a case in Crime No.583 of 2025 for the offences punishable under Section 318(4) of ‘the BNS.,’ and Section 21 of‘the BUDS Act’. 3. The learned counsel for the petitioner submits that the provisions of ‘the BUDS Act.,’ are not applicable to the case on hand, and except for ‘the BUDS Act.,’ the remaining offences are punishable with imprisonment of less than seven years. The petitioner is aged about 60 years and has a fixed place of abode. 4. Considering the facts and circumstances of the case, the gravity and nature of the allegations leveled against the Petitioner/Accused No.2 this
5. Court is inclined to grant pre-arrest bail to the Petitioner/Accused No.2. 6. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioner/Accused No.2 he shall be enlarged on bail subject to his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only), with two sureties for the like sum each to the satisfaction of the arresting police officials: 2 the BNS ^ the BUDS Act
3 The Petitioner/Accused No.2 shall make himself available for investigation as and when required; The Petitioner/Accused No.2 shall not cause any threat, inducement or promise to the prosecution witnesses; The Petitioner/Accused No.2 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. The Petitioner/Accused No.2 shall not leave the State of Andhra Pradesb limits without the express permission from the Station House Officer concerned. The Petitioner/Accused No.2 shall surrender his passport, if any, to the investigating officer. If he claims that they do not have a passport, he shall submit affidavits to that effect to the Investigating Officer. IV. V.
