The petitioner has filed this writ petition under Article 226 of the Constitution of India assailing the order dated 24-9-2025 (Annexure P/1) passed by the respondent No.3 /Collector, (Tribal Development) District Balrampur- Ramanujganj, CG by which the petitioner who is working as Head Master and Incharge of Superintendent at Government Girls Ashram Pashupatipur, Block Wadrafnagar, District Balrampur Ramanujganj has been relieved from the post of Incharge of Superintendent and she was directed to report her duties at Primary School, Korwatola, Block Wadrafnagar. 2. Learned counsel for the petitioner would submit that the respondent No.8 who is real sister of the petitioner due to some personal family dispute has made a complaint against her which is incorrect. Thus, he would pray for allowing the petition. 3. On the other hand, learned State counsel would submit that the petitioner has been working at same place since 2009 and more than 16 years have already lapsed and there is no illegality in passing the impugned order and would pray for dismissal of the petition. 4. I have heard learned counsel for the parties and perused the record. 5. Considering the fact that the petitioner holding the post of Head Master was given Incharge of Warden of Ashram School which is not the substantive post and also considering the well settled position of law that no government servant can insist to remain posted at a particular forever and it is for the employer to post the employee considering the exigency, I do not find any illegality or perversity in the impugned order warranting interference by this Court. 6. Accordingly, the writ petition being devoid of merit is liable to be dismissed and it is hereby dismissed. No order as to costs.
