The present application under Section 528 of Bhartiya Nagarik Suraksha Sanhita (hereinafter referred as 'BNSS') has been filed for quashing of the entire proceedings, including charge-sheet dated 06.02.2025 and cognizance / summoning order dated 19.03.2025, of criminal case no. 9478 of 2024, arising out of case crime no. 178 of 2024, under Sections 191(2), 191(3), 190, 115(2), 352, 351(2), 333, 109 BNS, P.S. Rabupura, District Gautambudh Nagar, pending in the court of A.C.J.M.- I, Gautambudh Nagar. 3. After arguing at some length, learned counsel for the applicant submits that the prayer as made above is not being pressed and that applicant is aged about 70 years and he is suffering from serious ailment and thus a direction may be made to the court concerned to decide the bail application of applicant expeditiously and protection may be granted to the applicant till then. 4. In view of the aforesaid, it is directed that in case applicant appears/surrenders before the trial court concerned within a period of four weeks from today and applies for bail, his bail application shall be considered and decided expeditiously in accordance with settled law. For a period of four weeks from today or till the applicant appears/surrenders before the court concerned, whichever is earlier, no coercive action shall be taken against the applicant in the aforesaid case. 5.
