GP FOR REVENUE The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... to issue a writ, order or direction, more particularly one in the nature of writ of mandamus declaring the action of the respondents harrassing the petitioner by cling to the police station and forcing the petitioner to withdraw the W.P.No.11272 of 2020 pending before the this Hon’ble High Court is illegal, arbitrary, handedness and voilation of provisions of the constitution of India and to pass such other order or orders as this Hon’ble Court may deem fit just and proper in the circumstances of the case.” 2. Heard Sri P.N. Murthy, learned counsel for the petitioner and Sri V. Farooq, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that basing on a report from the complainant, the police have registered a case against the petitioner herein and others in Crime No.297 of 2020 of Podalakur Police Station, for the offence punishable under Sections 341 & 307 r/w 34 IPC. Learned Assistant Government Pleader would further submit that all the accused in Crime No.297 of 2020 were granted anticipatory bail by the Hon’ble Court of VIII Additional District Judge, Gudur vide Crl.M.P.No.665/2020. Thereafter, the Police never called the petitioner to the police station and never threaten him to withdraw W.P.No.11272 of 2020. 3 4. Recording the submissions made by the learned Assistant Government Pleader for Home, the Writ Petition is disposed of. However, the Police are directed to follow the due process of law relating to the case registered against the petitioner. There shall be no order as to costs.
