Learned counsel for the petitioner submits that the appellate authority i.e. 3'"* respondent instead of passing the order on the appeal preferred by the petitioner against the
order, dated 12.08.2024, passed by the 4‘*^ respondent, the very same primary authority i.e. 4**" respondent has issued impugned
order, dated 10.01.2025, apparently by referring to ‘Note orders’ alleged to have been issued by the S'"' respondent, which procedure is unknown to law. 4. When the appeal is supposed to be heard and disposed of by the 3'"'^ respondent, it alone has to dispose of by recording reasons. Further, though this Court on earlier occasion in W.P. No. 19847 of 2024, has specifically directed the appellate authority to dispose of the appeal after affording an opportunity of hearing to proper

Chandra Murthy, appearing for respondents 2 to 4 and 6, on instructions, submits that the order impugned in the writ petition only communicates the decision of the 3'"' respondent based on the ‘Note orders’ circulated and tried to justify the same. 5. 6. On perusal of the impugned order, it clearly discloses that the has been passed by the 4*^ respondent, though referring to ‘Note orders’ of the 3^^^ respondent. When the appeal is preferred before the 3'^ respondent, it is incumbent upon him to hear the petitioner and pass speaking orders considering the grounds raised in support of the appeal, which is clearly lacking in the present case. Therefore, the aforesaid order passed by the incompetent authority is unsustainable. same
7. Accordingly, the writ petition is allowed by setting aside the impugned order, dated 10.01.2025, passed by the 4**^ respondent and it is further directed that the 3'^ respondent shall dispose of the appeal preferred by the petitioner afresh after affording opportunity
CGR, W.RNo 10582 of 2025 of hearing and pass appropriate speaking orders strictly in accordance with law. No order as to costs.
