ORAL ORDER This petition is filed by accused No.7 under Section 439 of Code of Criminal Procedure, praying to grant bail in S.C.No.340/2019 (Crime No.34/2018 of Chamarajpet Police Station) pending on the file of Additional City Civil and Sessions Judge (CCH-57), Bengaluru, registered for offences punishable under Sections 143, 147, 148, 307 and 302 read with Section 149 of Indian Penal Code.

learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State.

The petitioner has been arrayed as accused No.7 in the charge sheet filed in Crime No.34/2018 and case has been committed to Sessions Court pending in S.C.No.340/2019 on the file of LVI Additional City Civil and Sessions Judge, Bengaluru. The petitioner has been granted bail by the Sessions Court in Criminal Miscellaneous No.4353/2019 by order dated 17.06.2019 and he has been released on bail on 08.09.2020. The petitioner appeared before the Sessions Court and subsequently, he remained absent on 12.07.2021 and NBW has been issued against the petitioner and he has been secured by executing NBW on 26.09.2025 and since then, he is in judicial custody. It is submitted that, due to mis-communication between the petitioner and his counsel, he could not appear before the Sessions Court. Now, the petitioner has deposited Rs.50,000/- towards forfeited bond amount of Rs.1,00,000/- before the Sessions Court on 18.12.2025 in S.C.No.340/2019. The said amount in deposit requires to be appropriated to the

State towards forfeited bond amount. The petitioner has undertaken to appear before the Sessions Court on all dates of hearing.
4. Considering all the above aspects, the petitioner has made out a case for grant of bail with conditions. In the result, the following;
ORDER The Criminal Petition is allowed. The petitioner is granted bail in S.C.No.340/2019 (Crime No.34/2018 of Chamarajpet Police Station) pending on the file of Additional City Civil and Sessions Judge (CCH-57), Bengaluru, subject to following conditions: i) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with one surety for the like-sum to the satisfaction of the trial Court. ii) The petitioner shall not tamper the prosecution witnesses either directly or indirectly.

iii) The petitioner shall appear before the trial Court on all dates of hearing unless exempted by the Court and cooperate for speedy disposal of the case. The trial Court shall appropriate the amount of deposit in a sum of Rs.50,000/- deposited by the petitioner to the State towards forfeited of bond executed by him.
