Heard learned counsel for the petitioner and perused the record. 2. This petition has been filed for expediting the Execution Case No. 35 of 1998 (Pramod Kumar Singh v. Subhash Chandra and others). The execution case was filed in the year 1998 for executing the judgment and decree dated 12.02.1998 for specific performance. 3. Learned counsel for the petitioner states that the aforesaid execution application is pending since 1998. It is further contended that several dates have been fixed but the same has not been decided yet. He prayed that the same may be decided, expeditiously. 4. From the perusal of the order sheet, it is apparent that the several dates have been fixed but the execution application has not been decided yet. 5. No useful purpose would be served in keeping this petition pending. 6. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the present petition stands disposed of finally with a direction to Additional Civil Judge (Senior Division), Court No. 4, Varanasi to consider and decide the aforementioned execution application, in accordance with law, expeditiously, preferably within a period of six months from the date of production of a certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties provided that there is no other legal impediment.
