Raju C.N., learned counsel for the petitioner and Sri. Suresh R., learned counsel for the respondent. 2. Present petition is filed by the petitioner/wife under Section 24 of the Code of Civil Procedure, with the following prayer: "Wherefore, it is necessary that this Hon'ble court be pleased to : Allow the petition and thereby oorder for transfer of M.C.No.217/2025 which pending in Family Court at Davanagere which is as per ANNEXURE-"A" to th Family Court, at Shivamogga" 3. On account of strained matrimonial relationship, the husband has filed the petition under Section 9 of the - 3 - HC-KAR NC: 2025:KHC:48731 CP No. 384 of 2025 Hindu Marriage Act for restitution of conjugal rights on the file of Family Court, Davangare, whereas wife has filed a petition for maintenance at Shivamogga. 4. Therefore, wife is seeking transfer of pending matrimonial case to Davangaram. 5. If the petitioner is willing to join the husband, she may appear before the Family Court, Davangere and then join the husband. 6. If she is not, then she can effectively appear before the Davangere Court through video conferencing facility and then contest the matter. 7. If the petitioner by files an application before the Court at Davangere, to participate in the proceedings through video conference, learned Trial Judge at Davanagere shall permit her to do so. - 4 - HC-KAR NC: 2025:KHC:48731 CP No. 384 of 2025 8.
