Counsel for the Respondent(S): 1.GP FOR LABOUR 2.ARAVALA RAMA RAO The Court made the following: ORDER When the matter came up on 23.01.2025, Sri Aravala Ramarao, learned counsel, submitted that consequent to his appointment as Standing Counsel for APSRTC, he had issued notice to the petitioner to make alternate arrangements. Subsequently, it is brought to the notice of this court that the V ‘.W<P.9<fo. 16824 of2007 V 2 notice sent to petitioner was neither returned nor any acknowledgment in proof of service of the same on the petitioner was received. Therefore, the registry is directed to issue notice to the petitioner. The endorsement made by the registry shows that the notice addressed to the petitioner was returned unserved with endorsement 'no such person in this depot'. Thereafter, the learned counsel sought time to obtain correct address particulars of the petitioner and accordingly the matter was listed today. Today, the learned counsel submitted that despite best efforts he could not get the address particulars of the petitioner. 2. The writ petition is of the year 2007 and as per the cause title, the petitioner was aged 52 years. By now, the petitioner would be aged more than 70 years and he would have retired from service on attaining the age of superannuation about 10 or 12 years ago. After 23.06.2010, this matter came to be listed for the first time in the year 2025. The inaction on the part of the petitioner in not contacting his Advocate to ascertain the stage of the proceedings for more than 15 years would indicate that the petitioner is not interested to prosecute the matter and the cause in this writ petition would not have survived. Hence, this writ petition can be dismissed as infructuous. 3. Accordingly, the writ petition is dismissed as infructuous. In case, the petitioner has any interest to prosecute the matter and if cause still survives. ■^(PMo.l6824of2007 3 he can file appropriate application for period of two (02) months from today.
