Heard Sri Dileep Kumar Srivastava, learned counsel for revisionist, Sri Pawankumar Dubey, learned counsel for respondent no. 2 and learned AGA for the State. Revisionist, Sri Anurag Diwvedi and respondent no. 2 Smt. Ranjna Diwvedi are present in person before the Court.
Learned counsel for revisionist submits that the revisionist has brought two demand drafts for sum of Rs. 2,50,000/- each (total Rs. 5,00,000/-) pursuant to the earlier order dated 20.2.2025 passed by this Court and the settlement agreement has also been filed by the parties in compliance of the order dated 20.2.2025, therefore, it is prayed that the case may be decided in terms of settlement arrived at between the parties. He further submits that he is ready to hand over the demand drafts, dated 14.2.2025, to respondent no. 2, Smt. Ranjna Diwvedi for sum of Rs. 2,50,000/- each, which have been issued by Punjab National Bank, Branch- Ghooran Talaiya, Shahjahanpur in favour of respondent no. 2 Smt. Ranjna Diwvedi. The demand drafts have been received by respondent no. 2 Smt. Ranjna Diwvedi before the Court and she is at liberty to get the same encashed through her bank account. The parties have disclosed in settlement agreement that there are as many as seven cases, civil as well as criminal in nature, pending
between them in different courts. Both the parties have amicably settled their disputes after taking Rs. 5,00,000/- through demand drafts by respondent no. 2, which have been issued in favour of respondent no. 2. Both the parties undertake that they will not interfere in the life of each other in future and they agreed to resolve all the disputes and further continuance of proceedings pending before this Court and other courts, is nothing but formality and futile exercise. The judgement rendered by the Hon'ble Apex Court in the case of Schigi alias Pappu and others Versus Radhika and another 2012 (VI) JIC page 376 has been cited in support of compromise. After hearing learned counsel for the parties, perusing the material on record as well as joint affidavit / settlement agreement dated 4.3.2025, it is clear that the parties have settled their disputes and respondent no. 2 has undertaken to get all the cases disposed of after taking Rs. 5,00,000/- as one time settlement from the revisionist. Thus, the instant revision is disposed of in terms of the compromise dated 4.3.2025.
The parties are at liberty to file fresh compromise in terms of settlement cited in the present case through joint affidavit / settlement in other cases pending before the different Courts concerned and the same will be accepted and decided by the courts below, if there is no legal impediment. It need not be observed, that the parties are free to lead their life in their own way without any interference by the other side.
