Somisetty Ganesh Babu SC For VUDA and MUDA The Court made the following: 3 Order: Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in trying to interfere with the petitioner’s peaceful possession and enjoyment of the property, i.e., Zerioti land to an extent of Ac.0.45 cents in Survey No.87/2 of Aasakapalli Village, Sabbavaram Mandal, Visakhapatnam District, including by way of eviction under the guise of Navaratnalu – Pedalandariki Illu. 3. On the other hand, the learned Assistant Government Pleader appearing for the respondent Nos.1, 2 and 4 submits that the respondent authorities concerned would follow the due procedure with respect to the subject land. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to deal with the subject property strictly in accordance with law, and if so warranted for any public purpose, if the petitioners are otherwise found to be possession of the same, they shall be dealt with in accordance with law giving due opportunity of hearing to the petitioners and if any dispossession from the subject land shall not be made except by following the due process of law. . 4 5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Interim orders, if any, stands vacated.
