THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE V SRISHANANDA ORAL ORDER 1. Heard Sri. Sanath Kumar H. for Sri. Ajay Kadkol T., learned counsel for the petitioner. None present for the respondent though copy of the petition said to have been - 3 - HC-KAR NC: 2025:KHC:48744 CP No. 222 of 2025 served on the counsel who represents the respondent in the Court below. 2. Husband has filed the present petition under Section 24 of the Code of Civil Procedure with the following prayer : "WHEREFORE, the Petitioner above named humbly prays that this Hon'ble Court be pleased to : Order the Transfer of the case in M.C.No.308/2024 pending before he I Addl. Principal Judge, Family Court at Tumakuru to a Court of Appropriate jurisdiction i.e., Principal Judge, Family Court at Bangalore City, which is produced as Annexure - A." 3. Facts of the case are as under : 3.1 On account of strained relationship, wife has filed a case before the III Metropolitan Magistrate Traffic Court at Bengaluru, under Sections 19, 20 and 22 of the Protection of Women from Domestic Violence Act. She has also filed a matrimonial case for dissolution of the - 4 - HC-KAR NC: 2025:KHC:48744 CP No. 222 of 2025 marriage between the parties in MC No.308/2024 on the file of Family Court, Tumakuru. 3.2 Now the husband is seeking that the case at Tumakuru is also to be transferred to Bangalore for adjudication. 4. Having heard the counsel for petitioner, it is noted that the Family Court at Tumakuru had the jurisdiction to entertain the petition. 5. The ground for transfer made by the husband is that two cases have been filed by the wife against him only to harass him, one at Bangalore and one at Tumkur. Therefore, he wants the transfer of the case at Tumakuru to Bangalore. 6. Taking note of the fact that video conferencing facility is now available at Court at Tumakuru, husband can avail the said facility and effectively participate in the divorce petition at Tumakuru. - 5 - HC-KAR NC: 2025:KHC:48744 CP No. 222 of 2025 7. If the petitioner husband makes such an application, the learned trial judge at Tumakuru permit the husband to appear through video conferencing and effectively participate in the said proceedings. 8.
