1. Petitioner has filed this writ petition seeking direction to the respondents to consider his case as per circular dated 07/03/2012.
2. Mr. B.N. Mishra, learned counsel for the petitioner, would submit that though petitioner’s case is said to have been considered and recognized, but a one line order has been passed stating that he was not in service since 2009, and therefore, his case has been rejected for regularization.
3. Mr. Rahul Tamaskar, learned State counsel, would submit that a 6 member committee has scrutinized the case of the petitioner and he was found ineligible for regularization as though he joined duty but after working for some time, he remained absent from duty since 2009.
4. I have heard learned counsel for the parties, considered their submissions and perused the records.
5. True it is that petitioner has been declared ineligible for regularization holding that on the date of consideration, he was not in service whereas according to the petitioner, he was in service and is eligible for regularization.

Be that as it may, respondent No. 3 is directed to consider the case of petitioner’s regularization strictly in accordance with law from the date on which other employees were considered for regularization i.e. on 27/07/2016 and pass a reasoned and speaking order afresh within two months from the date of receipt of a copy of this order. Petitioner is at liberty to file representation along with a copy of this
order before respondent No. 3.
7. With the aforesaid direction, this writ petition stands
disposed of. No cost(s).
