1. PUBLIC PROSECUTOR The Court made the following Order : The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.1 and 5 on bail in Crime No.52 of 2025 of
Governorpet Police Station, NTR Commissionerate, Vijayawada, registered against the Petitioners/Accused Nos.1 and 5 herein for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Heard the learned Counsel for the Petitioners and the learned Assistant Public Prosecutor. 3. This Court in Criminal Petition No. 6831 of 2025 on 03.09.2025 granted bail to Accused No.4. Similarly in Criminal Petition No. 7287 of 2025 on 03.09.2025 granted bail to Accused No.3. The Petitioner No.2/ Accused No.5 was allegedly carrying 4.5 Kgs of ganja, which is not a commercial quantity. So far 7 witnesses are examined. Learned Assistant Public Prosecutor would submit that four similarly criminal adverse antendents report against the Petitioner No.1/ Accused No.1. 4. Since the Petitioner No.2/ Accused No.5 is not carrying commercial quantity and he has been in judicial custody for the past 123 days, the request of Petitioner No.2/ Accused No.5 is considered for grant of bail. Howeveer, the Petitioner No.1/ Accused No.1 was allegedly found in possession of 20.48 Kgs of ganja, it is a commercial quantity. The request of Petitioner No.1/ Accused No.1 is not found convincing. Accordingly, the request of the Petitioner No.1/ Accused No.1 to grant bail is dismissed. 5.
Considering the nature and gravity of allegation levelled against the Petitioner, his alleged role played in this case, and the period of detention undergone by the Petitioner No.2/ Accused No.5, this Court is inclined to
enlarge the Petitioner No.2/ Accused No.5 on bail with the following stringent conditions:
6. In the result, the Criminal Petition is partlty allowed with the following conditions: i. The Petitioner No.2/Accused No.5 shall be enlarged on bail subject to his executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only), with two sureties each for the like sum each to the satisfaction of the learned III Additional Chief Judicial Magistrate, Vijayawada. ii. The Petitioner No.2/Accused No.5 shall appear before the Station House Officer, Governorpet Police Station, NTR Commissionerate, Vijayawada, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court. iii. The Petitioner No.2/Accused No.5 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. iv. The Petitioner No.2/Accused No.5 shall not commit or indulge in commission of any offence in future. v. The Petitioner No.2/Accused No.5 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required. vi. The Petitioner No.2/Accused No.5 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. vii. The Petitioner No.2/Accused No.5 shall surrender his passport, if any, to the investigating officer. If he claims that he do not have a passport, he shall submit an affidavit to that effect to the Investigating Officer. 7.
