p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK BLAPL No.10792 of 2025 Pradeep Vishnav @ Papu Lal @ Pardeep Kumar Vaishnab … Petitioner Mr. D.J. Sahoo, Advocate -versus- State of Odisha … Opposite Party Mr. T.K. Acharya, Addl. PP JUSTICE G. SATAPATHY Order No. ORDER(ORAL) 09.02.2026 04. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode). 2. This is the 2nd successive bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Kendrapara Town P.S. Case No.177 of 2024 corresponding to S.T. Case No. 08 of 2025 (G.R. Case No. 1581 of 2024) pending in the file of learned Sessions Judge, Kendrapara, for commission of offences punishable U/Ss. 127(3)/103 of BNS, on the main allegation of committing murder of one Raju @ Kurban Mansuri. 3. Heard, Mr. Dibya Jyoti Sahoo, learned counsel for the petitioner and Mr. T.K. Acharya, learned Addl. PP in the matter and perused the record including the copy of deposition of PWs. 1 to 17. Mr. Sahoo at the outset informs this Court that this is the 2nd successive bail application of the petitioner, but no bail application of the present petitioner is pending before any other forum except this one. p. 2 4. After having considered the rival submissions upon perusal of record, there appears allegation against the petitioner for committing murder of the deceased, but the informant and eye witnesses examined as PWs.7, 15 & 17 have not supported the prosecution allegation against the petitioner. In that view of the matter and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the pre- trial detention of the petitioner in custody since 26.08.2024 and taking into account the other circumstances on record in entirety including the inherent right of the accused to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merit, admits the Petitioner to bail. 5. Hence, the bail application of the Petitioner stands allowed and the Petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it. 6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules. (G. Satapathy) Judge S.Sasmal
