The petitioner has filed this writ petition seeking for the following relief(s); “i. Issue an appropriate writ, order, or direction, particularly in the nature of Mandamus, directing the Learned Labour Court, Durg, to expedite and conclude the proceedings pending before it in Case No. 41/ID Act/2024 (Civil), filed by the Petitioner under Section 33-C(2) of the Industrial Disputes Act, 1947, within a time-bound period or within such period as this Hon'ble Court may deem fit and proper in the interest of justice. ii. Direct the Respondent-Company to furnish and hand over to the Petitioner his Relieving Certificate Experience Certificate, and all other post-employment documents forthwith, if not already issued, so as to enable the Petitioner to secure alternative employment without further prejudice, in the interest of justice. iii. Learned counsel for the petitioner submits that the petitioner is a salaried individual with no independent source of income apart from his past employment, and the prolonged pendency of his claim has caused severe financial hardship. The Respondent-Company’s refusal to release his lawful dues and issue the relieving certificate has prevented him from securing fresh employment, thereby infringing his right to livelihood under Article 21 of the Constitution of India. Therefore, he prays that the learned Labour Court, Durg may be directed to expedite the proceedings and decide the matter within a reasonable period of time. 3. Considering the facts and circumstances of the case, and taking into account the submissions made hereinabove, it is observed that the learned Labour Court, Durg, shall make an earnest endeavour to expedite the trial in case No. 41/ID Act/ 2024 (Civil) and conclude the proceedings within a reasonable period of time subject to cooperation of the parties. 4.
