A case has been registered against the petitioner herein for the offences punishable under Sections 75(2), 76 of the Bharatiya Nyaya Sanhita, 2023 (for short ‘BNS Act’) and under Section 9(m) read with 10 of the Protection of Children from Sexual Offences Act, 2012 (for short ‘the POCSO Act’). 3. The case of the prosecution in brief is that: The victim girl is aged about 03 years and resident of Kavetipuram D.Wada, Nagari Mandal, Chittoor. The incident occurred prior to 20.01.2025 at the house of the accused, who is resident of the same village and he brought the victim girl to his house, disrobed her clothes, took her naked photos and misbehaved with her by touching her body, breast and private parts with sexual intent. Hence, a case has been registered against the petitioner herein. 4. Heard. Perused the record. 5. A perusal of the material on record goes to show that the accused/petitioner disrobed the victim’s clothes, took her naked 3 photos and misbehaved with victim girl by touching her body, breast and private parts with sexual intent. It is submitted by the learned Assistant Public Prosecutor that the investigation is at the nascent stage. 6. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner/accused. 7.
