GP FOR HOME The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 14210 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue an appropriate writ, order or direction more one in the nature of Writ of Mandamus declaring the action of the Respondent No.4 in harassing the Petitioner by calling him to Police Station and threatening him to settle civil disputes at the behest of Respondent Nos.5 and 6 is illegal, arbitrary and discriminative and violative Articles 14, 19 and 21 of the Constitution of India and Consequently direct Respondent No.4 not to harass the Petitioner by calling him to Police Station and pass.…” 2. Heard Sri M. Gowtham, learned counsel for the petitioner and Sri V. Farook, learned Assistant Government Pleader for Home for the respondents. 3. Learned counsel for the petitioner would submit that the police are calling the petitioner to the police station, in the absence of any crime registered and interfering with the civil disputes in between the petitioner and the unofficial respondents. Learned counsel would further submit that a direction may be given to the police. 4. Learned Assistant Government Pleader for Home, on written instructions would submit that respondent No.5 gave a report to respondent No.4. Based on the contents of said report, as the offence is non-cognizable, the Station House officer sent a requisition to the learned V Additional Judicial Magistrate of First Class, SPSR Nellore District with a request to issue permission to register the FIR and investigate the matter; however, the same is awaited. He would further submit that the police never called the petitioner to the police station and threatened him. 5. Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 6. Recording the above said submissions, the Writ Petition is disposed of. There shall be no order as to costs.
