THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.31679 OF 2025 ORDER:
1. The petitioner is aggrieved by the inaction of the 3rd respondent in considering the representation dated 04.08.2025.
2. The learned counsel for the petitioner submits that the 5th respondent has erected some unauthorized constructions in the open areas that were meant for common usage of the flat owners. In this regard, the petitioner had submitted representations, which were not considered.
3. The learned Standing Counsel appearing for respondents 3 and 4 submits that the 5th respondent is said to have erected a transformer in the open area and that a building was constructed in pursuance of the permission obtained from the then Gram Panchayat. It is further submitted that the occupancy certificate for the building was issued by the then Gram Panchayat, in the month of January 2021 itself. It is submitted that any developmental activity would be dealt with in accordance with law. Insofar as the representation of the petitioner is concerned, it is not known whether the same was duly served on the respondents or not as the same was not sent by registered post.
4. Considering the submissions, the Court is inclined to dispose of the writ petition directing the petitioner to submit a fresh representation

to the 3rd respondent. On receipt of the representation, the 3rd respondent shall depute a competent officer to verify the allegations made therein and take necessary action by issuing notices to all concerned parties.
5. Accordingly, the writ petition is disposed of. No costs.
