The contempt case is filed alleging non-compliance of the order passed by this Court in WP.No.19424 of 2007. This Court directed the respondents therein to restore the promotion of the petitioner and grant service benefits to the petitioner from the date of passing of the impugned proceedings till the date of attaining the age of superannuation. 2. The learned counsel appearing for the petitioner submits that the respondents had partly implemented the orders and states that the respondents are yet to implement the order in letter and spirit and that they are yet to issue the following ; (i) Official letter restoring promotion to Scale 4 w.e.f. 24-08-2005 (ii) Service Benefits of 563 days of wages. (iii) Salary as applicable to Scale 4 from 05-05-2006. (iv) For specialist Officers, Extension of benefits of previous service vide CO: HRM LETTER CO: HRM: REG 26: 5606 Dt.01-07-2021 (3 yars back circular Letter) (v) Amendment to Pension Payment Order (PPO) (vi) Issue of Retiree Identity Card with designation of CM (vii) Designation in Pension slip to be changed to Scale Four 3. The learned counsel appearing for the respondents submits that all the points raised by the petitioner have been complied except for granting of service benefits and wages for the period of 563 days during which period the petitioner was on extraordinary leave. It is submitted that the petitioner was not on Sabbatical Leave and that apart the extraordinary leave of 563 days is beyond the permissible leave period, as such, the petitioner would CC.No.4235 of 2024 not be entitled for grant of wages/payment for those days. It is also submitted that the main prayer of the writ petitioner is also not to grant wages for the days during which he was not on duty. 4. Service benefits would not include settlement of claim for the period of 563 days during which period the petitioner was on extraordinary leave. Entitlement of leaves of any employee are governed by the Leave Rules. None of the rules which entitle the petitioner to claim for payment of wages for the period during which he was on extraordinary leave are placed before this Court. 5. That apart, on the facts of this case the respondents have complied with the order passed by this Court and this Court doesn’t find any grounds to entertain the contempt case. The order passed by this Court is complied by the respondents, as such, the contempt case deserves to be closed. 6. Accordingly, contempt case is closed. No costs.
