The present criminal misc. application has been filed by the applicant with a prayer to quash/ set-aside the impugned order dated 11.09.2025 passed by SDM, Kotdwar in BNSS Case No. 02 of 2025, State Vs. Bashwanand Khantwal and Another and also the order dated 19.09.2025 passed by learned Additional Sessions Judge, Kotdwar, District Pauri Garhwal in Criminal Revision No. 25 of 2025. 4. By the order dated 11.09.2025, the library room, study room, the office and the donation-box of the temple were sealed and its custody was handed over to the Revenue Inspector, Sukhro. 5. As per the instructions of learned counsel for the applicant, the S.D.M. is ready to hand over the keys of two rooms i.e. library and study room to the applicants. Therefore, learned counsel for the applicant have prayed that the Revenue Sub-Inspector, Sukhro be present on the date when the keys are handed over to the applicant so that the items inside the room be verified from the inventory, which must be in the possession of the Revenue Inspector, Sukhro. It is further requested by learned counsel for the applicant that since now the dispute between the Committee of Temple is non- existence as S.D.M. is ready to handover two rooms of the temple to the Committee. S.D.M. concern may consider opening the office of the temple and handing over the keys to the applicant as well and if he so thinks fit, the entire management of the temple be handed over to the Committee so that the temple can be managed effectively, as was done in the past. 6. S.D.M./ Tehsildar concerned is also directed to be present at the time of handing over the keys so that the items lying inside the rooms be verified. 7.
