Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed seeking following relief :- "Issue, an order, or direction in the nature of mandamus commanding and directing the Sub Divisional Officer, Kaptanganj, District Kushinagar (respondent no.2) to decide the petitioner's application dated 02.09.2024 within specified period as fixed by this Hon'ble Court in the interest of justice and also get the demarcation of the petitioner's plot on spot and pillar may be fixed." 3. Contention of learned counsel for the petitioner is that application for demarcation has been filed by the petitioner and the same has not been decided. 4. Learned Standing Counsel has invited attention of the Court to the application filed by the petitioner and submitted that the said application cannot be an application under Section 24 of the U.P. Revenue Code, 2006. 5. In view of the same, I am not inclined to interfere with the matter. 6. Accordingly, this writ petition stands disposed of with liberty to the petitioner to move an appropriate application u/s 24 of the U.P. Revenue Code, 2006 and in case such an application is filed within two weeks from today, the same shall be considered and decided by the competent authority within next three months from the date of production of a certified copy of this order after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties as well as giving a reasonable opportunity of leading evidence in respect of their case provided there is no other legal impediment.
