PUBLIC PROSECUTOR The Court Made the Following Order: The instant petition under Section 528 of the BNSS has been filed by the Petitioners/Accused Nos.1 to 8, seeking quashment of proceedings against them in C.C.No.774 of 2025 on the file of the learned Additional Judicial Magistrate of First Class, Markapur, for the offences under Sections 118(1), 115(2), 79 and 351(2) read with 3(5) of BNS. 2. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor for the State. 3. Learned counsel for the petitioners would submit that the petition may be disposed of dispensing with the presence of the petitioners before the trial Court and by giving liberty to the petitioners to raise such contentions before the trial Court in defence. 4. Considering the submissions made, the criminal petition is disposed of and the petitioners are at liberty to raise the present contentions before the trial Court in their defence and the learned trial Judge may appreciate them and take appropriate decision at appropriate stage over the matter in accordance with law. However, the presence of the Petitioners 2 to 8/Accused Nos.2 to 8 before the trial Court is dispensed with, except on the specific dates as directed by the trial Court.
