This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a writ, order or direction more particularly one in the nature of mandamus declaring the inactions of the respondents 2 to 3 for not setting the criminal Law in to motion in respect of the statement recorded by on duty police constable in the Government General Hospital, Nellore on 01-9-2021 as illegal, arbitrary and violation of Article 14, 19, 21 and 300A of the Constitution of India, contra to Sec.154(3) of Cr.PC and consequently direct the 2nd respondent to take steps for registering FIR On the statement of the petitioner dated 1-9- 2021 recorded by the police on duty in Government Hospital, Nellore and pass..…”
2. When the matter was taken up for hearing, Sri V.Farook, learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the hospital intimation of the Petitioner, a case in Crime No.240 of 2021 under Section 323 r/w 34 of IPC, at Dargamitta Police Station on
06.10.2021.
