The petitioner has filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 with following prayer:- “a. to quash impugned F.I.R. No. 126/2019 (part of Annexure P/1) dated 18.4.2019 for the offence under Section 354D; b. To kindly be pleased quash the impugned Chargesheet No. 152/2019 dated 06.07.2019 (Annexure P/1) filed the respondent no.1 U/s 354D & 506 of I.P.C against the petitioner; c. To kindly be pleased to quash of impugned order dated 06.08.2019 & 21.03.2024 (Annexure P/2) passed in Criminal Case No.2810/2019 pending before the learned Judicial Magistrate 1st Class, Bilaspur (C.G.) for further trial and to quash all the subsequent proceedings (if any) initiated against the petitioner on the basis of impugned FIR No. 126/2019. d. And/or any other relief/ relief's which this Hon'ble Court may think fit and proper in the facts and circumstances of the case may please be also granted to the petitioner in the interest of justice” 3 3. Facts of the case are that the petitioner is an Assistant Professor by profession and employed in the Department of Law of Guru Ghasidas University, Bilaspur and since the date of his appointment, he is imparting education to the students, who are studying in the University. At the risk of self-praise, it is submitted that petitioner is discharging all the duties assigned to him faithfully and diligently and till date no compliant has been received against the petitioner for harassing the female students mentally, physically or financially and recently the petitioner has been diagnosed as suffering from serious and fatal disease "Brain- tumor" and as per the medical-experts the petitioner has no option but to go for a critical brain-surgery. 4. The petitioner was shocked and surprised having come to know that based on written report dated 18.4.2019 lodged by respondent No.2, who was pursuing studies as a regular student of BA LLB course in the University, a First Information Report under Crime No.126/2019 has been registered against the petitioner for offence under Section 354D of the Indian Penal Code and the police are in search of the petitioner. On coming to know about the registration of offence against him, the petitioner immediately went to the Police Station at Koni on 30.04.2019 and he was granted bail on the same from the Police Station at Koni Distt. Bilaspur. 5. On completion of investigation, the police has submitted the charge-sheet for offence under Sections 354D and 506 of the 4 IPC before the Court of Judicial Magistrate First Class, Bilaspur. The petitioner preferred an application under Section 239 of the CrPC for his discharge from the charge under Section 354D & 506 of the IPC. However, the learned Magistrate vide order dated 21.3.2024 rejected the application and taken cognizance of offence under Section 354D of the IPC only against the petitioner, against which revision preferred before the revisional Court as well as criminal miscellaneous petition filed before this Hon'ble Court, which have been dismissed. 6. During pendency of the criminal case before learned trial Court, it was informed that the petitioner was suffering from serious and fatal disease "Brain-tumor" and as per the medical-experts the petitioner has no option but to go for a critical brain-surgery, thus looking to the medical condition of the petitioner, respondent no.2 does not want to continue the criminal proceeding against the petitioner. Hence, this petition. 7. Learned counsel for the petitioner submits that the dispute between the petitioner and respondent No.2 has been amicably settled outside of the Court, which has not been disputed by learned counsel appearing for respondent No.2. 8. This Court vide order dated 23.09.2025 directed both the parties to appear before the concerned trial Court, which shall verify the compromise entered into between them, as contained in the sealed envelope. The office was directed to 5 keep a photocopy of the said agreement in the sealed cover and return the original to the petitioner for filing before the concerned trial Court for the purpose of verification. The parties were directed to appear before the trial Court on 08.10.2025 and the trial Court was directed to submit its verification report to this Court. 9. In compliance of the said order, the trial Court has submitted its compliance report on 13.10.2025. Operative portion of the verification report states as under:- उपरोक्त विषयांतर्गत सादर लेख है वि माननीय छ०र्ग० उच्च न्यायालय विलासपुर द्वारा CRMP No. 2969 of 2025, पक्षार प्रेश दलई विरुद्ध छ०र्ग० राज्य, में पारिरत आदेश विदनां 23/09/2025 में याचि-ाता तथा उत्तरदाता क्रमां-02 ो उने मध्य हुए आपसी समझौते े संंध में वि-ारण न्यायालय े समक्ष लिललिखत समझौता प्रस्तुत रने तथा वि-ारण न्यायालय े द्वारा उक्त लिललिखत समझौते ो सत्याविपत र उसी रिरपोर्ट प्रस्तुत रने हेतु आदेशिशत विया र्गया है। उक्त विनद>श े परिरपालन में उभयपक्ष द्वारा इस न्यायालय में लंवित प्ररण क्रमां-2810/2019, पक्षार छ०र्ग० राज्य विरुद्ध प्रेश दलई में विदनां 08/10/2025 ो उपस्थिस्थत होर उने मध्य विनष्पाविदत सेर्टलमेंर्ट एग्रीमेन्र्ट विदनां 15/09/2025 प्रस्तुत विया र्गया। उपरोक्त सेर्टलमेंर्ट एग्रीमेन्र्ट े संंध में न्यायालय में उपस्थिस्थत आरोपी प्रेश दलई ी पह-ान प्ररण में संलग्न विर्गरफ्तारी पत्र में -स्थिस्पत फोर्टो तथा आरोपी े आधार ार्ड से ी र्गई तथा प्रार्थिथया रिरचिता दुे ी पह-ान प्ररण में सलग्न प्रार्थिथया े धारा 161 दण्र्ड प्रविक्रया संविहता े थन में -स्थिस्पत फोर्टो तथा प्रार्थिथया े आधार ार्ड से ी र्गई। उभयपक्षों से उने मध्य न्यायालय े ाहर 6 राजीनामा होने तथा उने मध्य विदनां 15/09/2025 ो विनष्पाविदत सेर्टलमेंर्ट एग्रीमेन्र्ट े संंध में पूछे जाने पर उभयपक्ष द्वारा आपस में राजीनामा होना स्ीार विया तथा प्रार्थिथया रिरचिता दुे े द्वारा आरोपी प्रेश दलेई े विरुद्ध थाना ोनी े अपराध क्रमां- 126/2019 से उत्पन्न आपराचिध प्ररण क्रमां 2810/2019 ो आर्गे नहीं -लाया जाना व्यक्त विया। इस प्रार प्ररण े आरोपी तथा प्रार्थिथया े मध्य विदनां 15/09/2025 ो विनष्पाविदत सेर्टलमेंर्ट एग्रीमेन्र्ट ी तस्दी ी र्गई जो वि सही होना पाया र्गया। अतः माननीय महोदय ी ओर CRMP No.-2969 of 2025 में पारिरत आदेश विदनां 23/09/2025 े परिरपालन में सत्यापन प्रचितेदन (Verification Report) अलोनाथ सादर प्रेविषत है।. The verification report is taken on record. 10. A bare perusal of the said report, it appears that the trial Court has stated that upon inquiry from both parties regarding the out-of-court settlement between them and the settlement agreement executed on 15/09/2025, both parties admitted to having reached a mutual settlement. Complainant Ritika Dubey expressed that she would not pursue Criminal Case No.2810/2019, arising from FIR No.126/2019 registered at Police Station Koni, against accused Pravesh Dalei. Thus, the settlement agreement executed on 15/09/2025 between the accused and the complainant was verified and found to be correct. 11. Considering the settlement arrived at between the parties which has been verified by the trial Court by its verification report dated 13.10.2025, F.I.R. No. 126/2019 (part of Annexure 7 P/1) dated 18.4.2019 for offence under Section 354D of the IPC, Chargesheet No. 152/2019 dated 06.07.2019 (Annexure P/1) filed by respondent No.1 under Sections 354D & 506 of the IPC against the petitioner, the impugned order dated 06.08.2019 & 21.03.2024 (Annexure P/2) passed in Criminal Case No.2810/2019 by the Judicial Magistrate First Class, Bilaspur and all the subsequent proceedings initiated against the petitioner on the basis of impugned FIR No.126/2019 are hereby quashed. 12.
