The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioner/Accused No.2 for granting of pre-arrest bail in connection with Crime No.227 of 2025 of Bommuru Police Station, Rajahmundry, East Godavari District, registered for the alleged offence punishable under Section 386 read with Section 34 of Indian Penal Code (for brevity ‘the IPC’) on the allegation of criminally extorted the defacto complainant. 2
2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. The petitioner/accused No. 2 is the son of accused No.1. Accused No.1 has already been granted regular bail by the learned trial Court concerned. Accused No.2 is working as employee on contract basis in the office of District Collector, Kakinada. Accused No.1 runs an old age home, where the victim/defacto complainant was admitted. The petitioner/accused No.2 is no way connected with the management of the old age home. The learned Assistant Public Prosecutor submits that only four witnesses have been examined so far. The investigation is at a nascent stage, and the amount allegedly extorted from the defacto complainant by the accused is yet to be recovered. 4. As per the records, the defacto complainant initially submitted a representation to the Superintendent of Police, Rajahmundry, which was forwarded to the Inspector of Police, Bommuru Police Station, Rajahmundry for necessary action, stating that a certain amount was given to accused No.1. Subsequently, the defacto complainant submitted another representation, registered as FIR No. 227 of 2025 at Bommuru Police Station, alleging that accused No.1 had extorted an amount of Rs.1,80,000/- from him. Accused No.1 has also submitted a representation to the Principal District Judge, Rajahmundry, stating that the police pressured him to vacate the premises where he runs the old age home because he gave deposition in favor of a

rowdy sheeter named Srinivasa Yadav.
Accused No.1 has detailed all of the above in his representation to the Principal District Judge, Rajahmundry, dated 06.06.2025. 5. Considering the facts and circumstances, the gravity and nature of the allegations levelled the Petitioner, this Court is inclined to grant pre-arrest bail to the Petitioner/ Accused No.2. 6. In the result, the Criminal Petition is allowed with the following conditions: i. In the event of arrest of the Petitioner/Accused No.2, he shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials; ii. The Petitioner/Accused No.2 shall make himself available for investigation as and when required; iii. The Petitioner/Accused No.2 shall not cause any threat, inducement or promise to the prosecution witnesses; iv. The Petitioner/Accused No.2 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioner/Accused No.2 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. 4
vi. The Petitioner/Accused No.2 shall surrender his passport, if any, to the investigating officer. If he claim that he does not have passport, he shall submit an affidavit to that effect to the Investigating Officer. ________________________ Dr.Y. LAKSHMANA RAO, J. Date:13.10.2025, S D P
